- Primero. REVOCAR la sentencia del Juzgado
- Quinto. Laboral del Circuito de Bogotá, de fecha once (11) de junio de dos mil dos (2002). En su lugar, CONCEDER la protección del derecho fundamental al debido proceso conculcado por el Seguro Social.
- Segundo. ORDENAR al Gerente Nacional del Seguro Social o quien haga sus veces, que en el término máximo de un (1) mes contado a partir de la notificación de esta providencia, resuelva el recurso de apelación interpuesto por la demandante, y tenga en cuenta para ello, no solo las pruebas aportadas por ella, sino las necesarias para determinar las cotizaciones faltantes, fundamentándose en el principio de favorabilidad en la aplicación e interpretación de las normas laborales.
- Tercero. Por Secretaría General, líbrense las comunicaciones a que se refiere el artículo 36 del decreto 2591 de 1991.
