Primero. REVOCAR la sentencia de la Sala de Casación Laboral de la corte Suprema de Justicia. En su lugar, CONCEDER la tutela por violación del derecho a la seguridad social en conexidad con el derecho fundamental a la vida.
Segundo. ORDENAR al I.S.S., Seccional Bogotá, que en el término de treinta (30) días, contados a partir de la notificación de esta decisión, tome las medidas necesarias para que dentro de sus competencias constitucionales y legales, y previa valoración médica al demandante, revise nuevamente la solicitud de reconocimiento de la invalidez, teniendo en cuenta el dictamen del médico laboralista del I.S.S., quien señaló que la referida invalidez databa del 1º de mayo de 1994.
Tercero. Por Secretaría, líbrese, la comunicación prevista en el artículo 36 del decreto 2591 de 1991.
