Primero. REVOCAR la sentencia proferida por la Sala Penal del Tribunal Superior de Bogotá. En consecuencia, conceder la tutela de los derechos a la vida y seguridad social del demandante.
Segundo. ORDENAR a la Caja Nacional de Previsión Social que en el término de quince días revise la situación del actor en torno a su pensión de jubilación, aplicando para ello el principio de favorabilidad que rige la aplicación e interpretación de las normas laborales aplicables a su caso.
Tercero. Por Secretaría líbrese la comunicación de que trata el artículo 36 del decreto 2591 de 1991.
