administrando justicia en nombre del pueblo, y por mandato de la Constitución,
R E S U E L V E :
Primero. REVOCAR la sentencia proferida por el Juzgado
Quinto. Penal del Circuito de Bucaramanga el dieciocho (18) de octubre de 1996, dentro de la acción de tutela instaurada por la señora Teofilde Sanabria Vda. de Franco contra el Fondo de Pensiones Territorial de Santander.
Segundo. CONCEDER la tutela del derecho fundamental de petición, y en consecuencia, ordenar al Fondo de Pensiones Territorial de Santander, que si todavía no lo ha hecho, en el término de 48 horas siguientes a la notificación de la presente providencia, resuelva sobre la petición de reconocimiento y pago de pensión de jubilación elevada por la señora Teofilde Sanabria Vda. de Franco, a menos que con anterioridad a dicha notificación se hubiese resuelto la reclamación respectiva.
Tercero. COMUNICAR por Secretaría General de la Corte Constitucional, el contenido de la Sentencia al Juzgado
Quinto. Penal del Circuito de Bucaramanga, para que sean notificadas las partes, de conformidad con lo dispuesto por el artículo 36 del Decreto 2591 de 1991.
