- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E :
- Primero. REVOCAR parcialmente la sentencia proferida por el Juzgado
- Decimo.
- Quinto. Penal Municipal de Medellín, el nueve (9) de octubre de mil novecientos noventa y seis (1996), mediante la cual se denegó la tutela impetrada por el señor JOSE ALFONSO CALLE GUERRA.
- Segundo. CONCEDER la tutela del derecho fundamental de petición. En consecuencia, se ordena a la Dirección de la Caja Nacional de Previsión Social que por conducto de la autoridad correspondiente, proceda si aún no lo ha hecho, si todavía no lo ha hecho, proceda a resolver de fondo, la solicitud de pensión gracia presentada por el señor JOSE ALFONSO CALLE GUERRA, dentro del improrrogable término de cuarenta y ocho (48) horas contadas a partir de la notificación de esta sentencia.
- Tercero. NEGAR la solicitud de pago de la pensión gracia formulada por el accionante, de acuerdo a lo expuesto en la parte motiva de esta providencia.
- Cuarto. COMUNICAR esta providencia al Juzgado
- Decimo.
- Quinto. Penal Municipal de Medellín, para los efectos contemplados en el artículo 36 del Decreto 2591 de 1991.
