- Primero. MODIFICAR el fallo del 18 de agosto de 1999, proferido por el Juzgado Penal Municipal de Cali, en el sentido de amparar solamente el derecho de petición. En consecuencia, se ORDENA al Seguro Social que, si ya no lo hubiere hecho, decida de fondo la solicitud del actor -positiva o negativamente-, respetando fielmente el ordenamiento jurídico que rige la materia.
- Si, para la fecha de notificación de esta Sentencia, el Seguro Social hubiere proferido acto administrativo reconociendo la pensión solicitada, dicho acto sólo podrá ser revocado con el consentimiento expreso y escrito del titular del derecho reconocido o procediendo la Administración a demandar su propio acto.
- Segundo. DAR cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
