- Primero. CONFIRMAR la sentencias de los Juzgados 23 Penal Municipal y 50 Penal del Circuito de Bogotá, de los días 17 de octubre de 2002 y 28 de noviembre de 2002 respectivamente, que negaron la tutela en relación con el traslado de la demandante de la EPS Sanitas a EPS Cafesalud.
- Segundo. REVOCAR las anteriores decisiones en lo que respecta al derecho a la salud de la demandante, aspecto por el cual se concede la tutela. En consecuencia, se ordena a EPS Sanitas que, si todavía no lo ha realizado, reinicie la atención de los servicios de salud de la demandante y su núcleo familiar.
- Tercero. Por Secretaría, líbrese la comunicación de que trata el artículo 36 del Decreto 2591 de 1991.
