- Primero. REVOCAR los fallos proferidos por el Juzgado
- Primero. de Familia de Bucaramanga y la Sala de Familia del Tribunal Superior de Bucaramanga, el 22 de noviembre de 1999 y 18 de enero de 2000, respectivamente. En su lugar CONCEDER la acción de tutela interpuesta por Rosa Merida Blanco García contra el Seguro Social
- Segundo. REVOCAR el fallo proferido por el Juzgado 36 Penal Municipal de Medellín, el 11 de enero de 2000. En su lugar CONCEDER la acción de tutela interpuesta por Jeny Vásquez Restrepo contra el Seguro Social
- Tercero. ORDENAR a la EPS del Seguro Social, que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo, proceda a pagar la licencia de maternidad a las señoras Rosa Merida Blanco García y Jeny Vásquez Restrepo.
- Cuarto. LÍBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
