- Primero. REVOCAR la providencia proferida por el Tribunal Superior del Distrito Judicial de Cartagena, de 7 de mayo de 2002 y en su lugar TUTELAR los derechos fundamentales a la maternidad, a la protección del recién nacido y al mínimo vital de la señora Emerita Correa Alvear, por las razones expuestas en la parte motiva de este fallo.
- Segundo. ORDENAR a COOMEVA E.P.S., que dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo proceda a reconocer y pagar a favor de la señora Emerita Correa Alvear el valor de la licencia de maternidad.
- Tercero. Líbrese por Secretaría, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
