- Primero. REVOCAR la sentencia proferida el 15 de enero de 2004 por el Juzgado Once (11) Penal del Circuito de Bogota y en su lugar, CONFIRMAR el fallo de primera instancia proferido por el Juzgado Sesenta y Ocho (68) Penal Municipal de Bogota que concedio la tutela de los derechos fundamentales a la vida digna y la seguridad social en conexidad con el derecho al minimo vital de la senora MARIA MARCELA ROMERO WALTEROS y de su hija recien nacida y, en consecuencia, ORDENAR a la E.P.S. Compensar, que si aun no lo ha hecho, en el termino de cuarenta y ocho (48) horas siguientes a la notificacion de este fallo, proceda a pagar a la accionante la licencia de maternidad que le corresponde.
- Segundo. Por Secretaria General librense las comunicaciones previstas en el articulo 36 del Decreto 2591 de 1991.
