- PRIMERO. REVOCAR el fallo proferido por el Juzgado 17 Penal Municipal de Medellin, el 13 de febrero de 2002. En su lugar CONCEDER la accion de tutela interpuesta por Maria Eugenia Gomez Cuartas contra el Seguro Social.
- SEGUNDO. ORDENAR a la EPS del Seguro Social, que dentro de las cuarenta y ocho (48) horas siguientes a la notificacion de este fallo, proceda a pagar la licencia de maternidad a la senora Maria Eugenia Gomez Cuartas.
- TERCERO. Para los efectos del articulo 36 del decreto 2591 de 1991, el juzgado de origen hara las notificaciones y tomara las medidas conducentes para el cumplimiento de esta sentencia.
