- Primero. REVOCAR las sentencias proferidas por el Juzgado Doce Penal Municipal de Barranquilla y por el Juzgado
- Cuarto. Penal del Circuito de Barranquilla, por las razones expuestas en el presente fallo.
- Segundo. CONCEDER la tutela impetrada por Manuel Marquez Reales contra Cafesalud por desconocimiento del principio de continuidad del servicio publico de salud que implica violacion al derecho a la vida, a la integridad personal y a la dignidad. Por consiguiente ORDENAR a Cafesalud que, si no lo ha hecho, se practique la operacion que los medicos indicaron se le hiciera a Manuel Marquez Reales ,teniendo en cuenta el cubrimiento de semanas cotizadas, desde el 13 de junio de 1995 en adelante, respetando la antiguedad, como ya se dijo en la parte motiva de esta sentencia.
- Tercero. COMUNIQUESE la presente sentencia al Juzgado Doce Penal Municipal de Barranquilla para que sea notificada a las partes, de acuerdo con lo dispuesto en el articulo 36 del Decreto 2591 de 1991.
