  1. En merito de lo expuesto, la Sala Tercera de Revision,
  2. R E S U E L V E:
  3. PRIMERO. REVOCAR las sentencias proferidas por el Tribunal Administrativo de Cundinamarca, Seccion Segunda, el 13 de diciembre de 1994, y por el Consejo de Estado, Seccion Tercera, el 26 de enero de 1995.
  4. SEGUNDO. CONCEDER TRANSITORIAMENTE la tutela del derecho fundamental a la seguridad social al senor RAUL HUMBERTO ESTUPINAN GUERRERO y, en consecuencia, ORDENAR al representante legal de la sociedad CONSTRUCCIONES PROTEXA S.A. que, en el termino de 48 horas contadas a partir de la notificacion de la presente providencia, se sirva cancelar mensualmente la diferencia dineraria entre la pension de jubilacion reconocida por la empresa al petente y la pension de vejez reconocida al mismo por el Instituto de Seguros Sociales mediante Resolucion 000733 del 8 de febrero de 1993, mientras se decide definitivamente, por las autoridades competentes, la controversia entre la empresa demandada y el Instituto de Seguros Sociales.
  5. TERCERO. LIBRESE comunicacion al Tribunal Administrativo de Cundinamarca, Seccion Segunda, con miras a que se surta la notificacion de esta providencia, segun lo establecido en el articulo 36 del Decreto 2591 de 1991.
