- en nombre del Pueblo y por mandato de la Constitución,
- R E S U E L V E :
- Primero. Revocar la sentencia proferida por el Tribunal Superior del Distrito Judicial de Santafé de Bogotá -Sala Penal-, de fecha octubre catorce (14) de mil novecientos noventa y dos (1992), en el asunto de la referencia, por las razones precedentes, y en su lugar conceder la tutela como mecanismo transitorio del derecho a la educación de que es titular el señor EDGAR CASTRO, en ejercicio del cual le debe ser permitida, con los ajustes necesarios a su relación laboral, su asistencia a las clases en la Facultad de Leyes y Jurisprudencia de la Universidad INCCA de Colombia, en la que se encuentra matriculado. El peticionario dispondrá del término legal de cuatro (4) meses para instaurar las acciones correspondientes ante los jueces competentes.
- Segundo. La Universidad INCCA de Colombia, representada por su Rectora, doctora LEONOR GARCIA DE ANDRADE, dará cumplimiento al presente fallo dentro de las cuarenta y ocho (48) horas siguientes a su notificación. El desacato a esta decisión dará lugar a la imposición de las sanciones contenidas en los artículos 52 y 53 del Decreto 2591 de 1991.
- Tercero. Comuníquese al Juzgado Treinta y Nueve (39) Penal del Circuito de Santafé de Bogotá, la presente decisión para que sea notificada a las partes conforme lo ordena el artículo 36 del Decreto 2591 de 1991.
