- Primero. Revocar el fallo proferido el 7 de febrero de 2001 por la Sala de Casación Laboral de la Corte Suprema de Justicia, dentro de la acción de tutela interpuesta por Mariela Vásquez Rivillas contra el Instituto de los Seguros Sociales, Seccional Caldas. En su lugar conceder la protección deprecada por la actora.
- Segundo. Ordenar a la EPS - Instituto de los Seguros Sociales, Seccional Caldas, que dentro de las cuarenta y ocho (48) horas siguientes a la notificación de este fallo proceda a reconocer y pagar a favor de la señora Mariela Vásquez Rivillas el valor de la licencia de maternidad impetrada.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
