- Primero. CONFIRMAR la decisión proferida por el Juzgado
- Primero. Civil municipal de Neiva en la acción de tutela instaurada por la señora Bertha Isabel Romero Cabrera contra CAFESALUD E.P.S., pero por las razones expuestas en la parte motiva de esta sentencia.
- Segundo. REVOCAR las decisiones proferidas por el Juzgado
- Tercero. Civil del Circuito de Pasto y la Sala Civil- Familia del Tribunal Superior del Distrito Judicial de Pasto, en la acción de tutela interpuesta por la señora Orfa Nidia Castillo contra el Instituto de Seguros Sociales - Seccional Nariño -. En consecuencia, se ordenará a la E.P.S. del Instituto de Seguros Sociales, con sede en Pasto, que dentro del término de cuarenta y ocho horas (48) a partir de la notificación personal de esta providencia, proceda a pagar la prestación económica de licencia por maternidad a que tiene derecho la demandante.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
