- en nombre del pueblo y por mandato de la Constitución,
- R E S U E L V E
- Primero. CONFIRMAR el fallo de segunda instancia, proferido en el proceso de la referencia por el Juzgado
- Cuarto. Penal del Circuito de Palmira, mediante el cual se resolvió de manera definitiva la tutela interpuesta por Gloria Amparo Gallego Román en contra del director del Hospital San Roque del Municipio de Pradera, Valle; advirtiéndole a la demandante que deberá iniciar el correspondiente proceso administrativo dentro de los cuatro meses siguientes al fallo de tutela, tal como lo ordena el artículo 9º del Decreto 2591 de 1991, so pena de quedar sin efectos la orden impartida en este fallo.
- Lo anterior sin perjuicio de que el cargo que aquella viene ejerciendo provisionalmente, sea ocupado de manera definitiva una vez se lleve a cabo el concurso de méritos a que ha hecho referencia el director del hospital.
- Segundo. DESE cumplimiento a lo previsto por el artículo 36 del Decreto 2591 de 1991.
