- Primero. REVOCAR la providencia proferida por Juzgado
- Segundo. Civil del Circuito de Santa Marta, el 16 de octubre de 2001 y en su lugar TUTELAR los derechos fundamentales a la maternidad, a la protección del recién nacido y al mínimo vital de la señora Arelys Merith Aguirre Jiménez, por las razones expuestas en la parte motiva de este fallo.
- Segundo. ORDENAR a la E.P.S. -Instituto de Seguros Sociales, Seccional Magdalena- que dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo proceda a reconocer y pagar a favor de la señora Arelys Merith Aguirre Jiménez el valor de la licencia de maternidad.
- Tercero. Líbrese por Secretaría, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
