- Primero. Revocar el fallo proferido por la Sala Civil del Tribunal Superior de Bogotá, el veinticuatro (24) de septiembre del año dos mil uno (2001), dentro del proceso de la referencia.
- Segundo. Tutelar el derecho a la vida, la integridad y la salud de Diana María Pinilla Sandoval y ordenar, en consecuencia, a Salud Colpatria EPS que se le siga suministrando Micofelonato Mofetil en las cantidades y frecuencia que el médico tratante determine, sin perjuicio del cobro que pueda hacer posteriormente la EPS al Fosyga, para recuperar los costos del medicamento.
- Tercero. Librar, por medio de la Secretaría General, las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991. Adicionalmente comunicar el fallo a la Sala Civil del Tribunal Superior de Bogotá, al Consejo Nacional de Seguridad Social en Salud y a la Superintendencia Nacional de Salud.
