- Primero. REVOCAR la sentencia proferida por el Juzgado
- Segundo. Civil Municipal de Itagüi, el 21 de noviembre de 2000 y, en su lugar, CONCEDER la tutela a Rafael Angel Mejía Arango, para la protección de sus derechos fundamentales a la vida y a la salud y, en consecuencia, ordenar a la EPS Susalud, que levante la suspensión de afiliación que pesa sobre el demandante y le preste la atención en salud que requiere, así como el suministro de los medicamentos necesarios.
- Segundo. DÉSE traslado a la Fiscalía General de la Nación para lo de su competencia.
- Tercero. ORDENAR a la Superintendencia de Salud que, en ejercicio de sus funciones de inspección y vigilancia, en un término no superior a tres (3) meses, diseñe y ponga en ejecución un programa que permita a los afiliados a las EPS, conocer de manera inmediata, ágil y oportuna, el estado de cuenta en relación con los aportes a cargo de los empleadores y, cuando sea del caso imponga las sanciones a que haya lugar.
- Líbrense por Secretaría, las comunicaciones de que trata el artículo 36 del Decreto 2591 de 1991.
