- R E SU E L V E :
- Primero. REVOCAR el fallo de la Sala Laboral del Tribunal Superior de Santafé de Bogotá, proferido el 18 de septiembre de 1997 y en su lugar CONFIRMAR el proferido por el Juzgado 16 Laboral del Circuito de Santafé de Bogotá el 22 de julio de 1997 en sus numerales 1° y 2° en cuanto concedió la tutela en favor de WILLIAM ALEXANDER SALGADO GOMEZ y ordenó al Instituto de los Seguros Sociales seguir prestando los servicios médicos asistenciales a la persona antes mencionada.
- Segundo. ADICIONAR el fallo de primera instancia en el sentido de que el ISS tendrá las acciones legales ejecutivas pertinentes contra la empresa MD MERCADEO INTEGRAL DE COLOMBIA LTDA. y las demás que estime pertinentes, para reclamar las cuotas debidas, las que además se necesiten para llegar al tope requerido para la atención médica.
- Tercero. Envíese copia de esta sentencia al Ministerio del Trabajo para la investigación correspondiente contra el empleador.
- Cuarto. Por Secretaría se librará la comunicación de que trata el artículo 36 del decreto 2591 de 1991, para los efectos del caso.
