- Primero. REVOCAR la sentencia del dieciséis (16) de noviembre de dos mil (2000), proferida por e1 Juzgado 38 Penal del Circuito de Bogotá, y la sentencia del diez (10) de octubre de dos mil (2000), proferida por el Juzgado 17 Penal Municipal de Bogotá, en el proceso de tutela de JUAN CARLOS RODRIGUEZ GARZON contra la E.P.S. COMPENSAR S.A.
- Segundo. CONCEDER al señor Juan Carlos Rodríguez Garzón la tutela de su derecho fundamental a la salud en conexidad con el derecho a la vida digna, a la integridad personal y al trabajo, y, en consecuencia ORDENAR al gerente o director de la Empresa Prestadora de Salud COMPENSAR S.A., que, en el término de cuarenta y ocho horas contadas a partir de la notificación de la presente providencia, suministre al señor Juan Carlos Rodríguez Garzón, identificado con cédula de ciudadanía número 79.904.012 de Bogotá, las bolsas de colostomía que requiere para evitar la vulneración de sus derechos fundamentales, sin desmedro del derecho de repetición que le pueda corresponder a la entidad demandada contra el Estado.
- Tercero. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
