- Primero. REVOCAR la sentencia expedida por el Juzgado 31 Penal Municipal de Medellín, el 4 de noviembre de 1998.
- Segundo. TUTELAR los derechos constitucionales fundamentales de Pedro Miguel Tamayo Ramírez a una vida digna y a la integridad física en conexión con su derecho a la salud; inaplicar el artículo 163 de la ley 100 de 1993 y ordenar al Instituto de Seguros Sociales Seccional Antioquia que, en el término de diez (10) días hábiles contados a partir de la notificación de la presente providencia, concluya el tratamiento quirúrgico al que fue sometido el demandante, retirando el material de osteosíntesis que aún tiene en su organismo.
- Tercero. LÍBRENSE por Secretaria General de esta Corporación, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991.
