- Primero. REVOCAR el fallo del siete (7) de febrero de mil novecientos noventa y seis (1996), proferido por el Juzgado Catorce Penal del Circuito de Cali, Valle, que a su vez revocó la sentencia del Juzgado 26 Penal Municipal de Cali, en virtud de la cual se había concedido la tutela impetrada.
- Segundo. Ordenar al Instituto de Seguros Sociales, Seccional Valle del Cauca, que por intermedio del servicio de Traumatología y Ortopedia de la Clínica Rafael Uribe Uribe, después de explicar al señor Juan Carlos Torres Ortíz, los riesgos y posibles complicaciones, se le preste el manejo quirúrgico en su miembro inferior derecho y el tratamiento que requiera para su rehabilitación, dentro de los recursos con que cuenta el Instituto de los Seguros Sociales para estos efectos, en desarrollo del tratamiento que se inició. Con tal fin, el paciente deberá autorizar al Instituto, y aceptar los riesgos propios de la operación
- Tercero. Ordenar que por Secretaría general se comunique esta providencia en la forma y para los efectos previstos en el artículo 36 del Decreto 2591 de 1991.
