- Primero. Revocar el fallo proferido por el Juzgado
- tercero. Penal del Circuito de Palmira, Valle el 3 de julio de 2001, al resolver sobre la accion de tutela incoada por Jose Alexander Becerra Londono contra la Secretaria de Salud Publica Municipal de Palmira y en su lugar, conceder la proteccion de los derechos a la salud y la vida del accionante, inaplicando en el caso concreto las disposiciones de rango reglamentario que, dadas las circunstancias del enfermo, son incompatibles con el articulo 11 de la Constitucion.
- Segundo. Ordenar a la Gerente de Salud Publica de Palmira que, dentro de las cuarenta y ocho (48) horas siguientes a la notificacion del presente fallo, inscriba y carnetice en el regimen subsidiado a Jose Alexander Becerra Londono y se le garantice el tratamiento que requiere para la recuperacion de su salud.
- Tercero. Por Secretaria, librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
