- Primero. REVOCAR el fallo proferido por el Juzgado
- Cuarto. Penal Municipal de Popayán el 3 de enero de 2000, al resolver sobre la acción de tutela incoada por María Esperanza Galindez de Sandoval, como agente oficiosa de William Andrés Calapsu, contra el Municipio de Popayán y, en su lugar, conceder la protección de los derechos a la salud y la vida de este último, inaplicando en el caso concreto las disposiciones de rango reglamentario que, dadas las circunstancias del enfermo, son incompatibles con el artículo 11 de la Constitución.
- Segundo. ORDENAR al Alcalde Municipal de Popayán que, dentro de las veinticuatro (24) horas siguientes a la notificación del presente fallo, inscriba y carnetice en el Sisben a William Andrés Calapsu y se le garantice la atención quirúrgica que requiere para la recuperación de su salud.
- Tercero. Por Secretaría, LIBRESE la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
