- PRIMERO. REVOCAR la sentencia proferida por el Juzgado 17 Penal del Circuito de Cali de 31 de septiembre de 2001 y en su lugar CONCEDER la tutela a favor de OSCAR DARIO RUA PATINO, por las razones expuestas.
- SEGUNDO. ORDENAR que en el termino de diez dias habiles, el senor OSCAR DARIO RUA PATINO sea remitido al hospital Mario Correa Renjifo de Cali, para que se le continue practicando el tratamiento ordenado, sin que para ello sea necesario presentar el carne respectivo.
- TERCERO. ORDENAR que en el termino de 5 dias habiles el senor OSCAR DARIO RUA PATINO sea encuestado por el SISBEN para que vuelva a figurar en la base de datos y se verifique su nivel de pobreza.
- CUARTO. Para los efectos del articulo 36 del decreto 2591 de 1991, el juzgado de origen hara las notificaciones y tomara las medidas conducentes para el cumplimiento de esta sentencia.
