- Primero. CONFIRMAR la sentencia proferida por el Juzgado
- Quinto. Penal Municipal de Santiago de Cali, en tanto no se aprecia vulneracion de derecho constitucional alguno.
- Segundo. REQUERIR la Secretaria de Salud Publica de Cali, para que en el termino de cuarenta y ocho ( 48 ) horas contadas a partir de este fallo, se inicien las diligencias necesarias para la carnetizacion en el Sisben del joven Samir Escobar y se le asigne una A.R.S.,de acuerdo a los cupos disponibles para ello, y teniendo en cuenta que padece de una enfermedad ruinosa cuya atencion no puede ser suspendida.
- Tercero. Por Secretaria, librese la comunicacion prevista en el articulo 36 del decreto 2591 de 1991.
