  1. Primero. REVOCAR el fallo proferido por el Juzgado Doce Penal del Circuito de Medellin el cuatro (4) de agosto de 1999 que a su vez revoco el fallo proferido por el Juzgado
  2. Septimo. Penal Municipal de Medellin, el diecisiete (17) de junio de 1999 respectivamente.
  3. Segundo. TUTELAR los derechos a la salud y seguridad social del actor y en consecuencia ORDENAR al Director Seccional de Salud de Antioquia, que en el termino de 48 horas contados a partir de la notificacion de este fallo autorice al Hospital General de Medellin para que realice, si aun no lo ha hecho, la intervencion quirurgica ordenada por su medico tratante.
  4. Tercero. SENALAR que la Direccion Seccional de Salud de Antioquia puede repetir los sobrecostos en que incurra cumpliendo esta orden en contra del Fondo de Solidaridad y Garantia del Sistema de Seguridad Social Integral en Salud.
  5. Cuarto. LIBRENSE las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
