- Primero. REVOCAR la sentencia adoptada por el Tribunal Administrativo de Santander el 20 de noviembre de 1996 y, en su lugar, tutelar los derechos fundamentales del actor.
- Segundo. ORDENAR al Instituto de los Seguros Sociales suministrar a José Joaquín Duarte Pérez la medicina que le fue recetada, en la posología adecuada, y por el término que requiera la evolución de su estado de salud.
- Tercero. ADVERTIR al Instituto de los Seguros Sociales que no debe dar lugar a violaciones futuras de los derechos del actor aquí tutelados, so pena de las sanciones previstas para el desacato en el Decreto 2591 de 1991.
- Cuarto. COMUNICAR esta providencia al Tribunal Administrativo de Santander para los fines previstos en el artículo 36 del Decreto 2591 de 1991.
