- Primero. REVOCAR la sentencia proferida por el Juzgado Treinta y Ocho Civil del Circuito de Santa Fe de Bogotá. En su lugar, conceder la tutela interpuesta por la señora Carmen Victoria Gómez Reyes. En consecuencia, se ordena a Capresub que en el término de cuarenta y ocho (48) siguientes a la notificación de esta providencia, reanude el suministro de los paquetes mensuales de pañales, de conformidad con las indicaciones médicas.
- Segundo. INAPLICAR por inconstitucional para el caso concreto, el acuerdo 083 de 1997, emanado del Consejo Nacional de Seguridad Social en Salud.
- Tercero. LÍBRENSE por la Secretaría General de esta Corporación, las comunicaciones de que trata el artículo 36 del decreto 2591 de 1991.
