- Primero. REVOCAR el fallo proferido por la Sala Civil Tribunal Superior de Bogotá del 22 de octubre de 1998.
- Segundo. Con arreglo al artículo 4 de la Constitución, INAPLICAR en el presente caso, por ser incompatibles con ella, el parágrafo del 12 de la Resolución 5261 del 05 de agosto de 1994, emanada del Ministerio de Salud, o las disposiciones que, con el mismo sentido, los hayan sustituido.
- Tercero. CONCEDER el amparo solicitado y, en consecuencia, ordenar a la "Entidad Promotora de Salud Humana S. A." que, dentro del término de las cuarenta y ocho (48) horas siguientes a la notificación de la presente providencia, suministre al niño ROBERTO CARLOS ARNEDO VARGAS los audífonos que le fueron prescritos por el médico tratante.
- Cuarto. DAR cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
