- Primero. REVOCAR la sentencia proferida por el Juzgado Cincuenta y Cuatro Civil Municipal de Bogota, y la sentencia adoptada por el Juzgado Treinta y Uno Civil del Circuito de Bogota, dentro de la accion de tutela instaurada por Yulder Alfonso Galindo Jimenez contra la Caja Nacional de Prevision Social -CAJANAL-, Seccional Bogota. En su lugar CONCEDER el amparo solicitado.
- Segundo. ORDENAR a la Caja Nacional de Prevision Social -CAJANAL- Seccional Bogota, que dentro de las cuarenta y ocho (48) horas contadas a partir de la notificacion de esta providencia, suministre al senor Yulder Alfonso Galindo Jimenez, el medicamento ISOTARTINOINA ORAL, ordenado por el medico tratante.
- Tercero. INAPLICAR por inconstitucional para el caso concreto, el literal b) del articulo 4o de la Resolucion No.5061 de 1997 del Ministerio de Salud.
- Cuarto. Por Secretaria General, librense las comunicaciones previstas en el articulo 36 del Decreto 2591 de 1991, para los efectos alli contemplados.
