- R E S U E L V E
- PRIMERO. REVOCAR en todas sus partes la sentencia de tutela del veintiseis (26) de marzo de mil novecientos noventa y dos (1992), proferida por la SALA LABORAL DEL TRIBUNAL SUPERIOR DEL DISTRITO JUDICIAL DE CALI, por la cual se denegó la acción de tutela solicitada por la señora ROSALBA DUQUE URREGO contra el Instituto de Seguros Sociales-Seccional Valle del Cauca.
- SEGUNDO. CONCEDER la tutela de su derecho a la igualdad de trato en la aplicación de la ley y demás normas jurídicas de carácter general, a la señora DUQUE URREGO y, en consecuencia, ORDENAR al Jefe de Prestaciones Económicas del Instituto de Seguros Sociales - Seccional Valle del Cauca -, que en el término de quince (15) días contados a partir de la notificación de esta sentencia, resuelva la solicitud de indemnización sustitutiva de la pensión de vejez, teniendo en cuenta la totalidad de las semanas cotizadas por la solicitante, incluidas aquellas como trabajadora independiente, lo cual acreditará inmediatamente después ante el Juzgado de primera instancia, so pena de incurrir en las sanciones establecidas en los artículos 52 y 53 del decreto 2591 de 1991.
- TERCERO. COMUNIQUESE por Secretaría a la SALA LABORAL DEL TRIBUNAL SUPERIOR DEL DISTRITO JUDICIAL DE CALI la presente decisión para que sea notificada a las partes conforme lo dispone el artículo 36 del Decreto 2591 de 1991 para los efectos allí contemplados.
