Solicita se ordene el suministro de los audifonos formulados por el medico tratante.
Derecho a la salud de los niños discapacitados como derecho fundamental y su proteccion por via de accion de tutela.

- Primero. REVOCAR la sentencia proferida por el Juzgado
- Segundo. (2) Penal Municipal de Chiquinquira y en su lugar CONCEDER la tutela de los derechos fundamentales a la vida digna, a la salud y a la seguridad social del menor MATEO ALBORNOZ SANCHEZ
- Segundo. ORDENAR a Sanitas EPS que dentro de las cuarenta y ocho (48) horas siguientes a la notificacion de este fallo, suministre los audifonos digitales de alta potencia tipo bata en los terminos prescritos por su medico tratante, sin que se pueda oponer para su negativa, la reglamentacion del POS.
- Tercero. SENALAR que la EPS accionada puede repetir contra el fondo de solidaridad el costo de las protesis auditivas que no figuran en el listado oficial del plan obligatorio de salud.
- Cuarto. Por Secretaria, librese la comunicacion de que trata el articulo 36 del decreto 2591 de 1991.
