Primero. REVOCAR la sentencia de octubre
primero. de 2003 proferida por el Juzgado
Segundo. Civil del Circuito de Sincelejo (Sucre) por las razones expuestas en la parte motiva de esta providencia. En consecuencia CONCEDER la tutela de los derechos fundamentales a la vida y a la salud del señor Rafael Antonio Hermosilla Cortinez.
Segundo. ORDENAR a Cajanal E.P.S. que dentro del perentorio término de cuarenta y ocho (48) horas a partir de la notificación personal de esta sentencia, autorice y haga entrega del medicamento HYTRIN 5 MG. al señor Rafael Antonio Hermosilla Cortinez en la cantidad y por el tiempo que lo considere necesario su médico tratante.
Tercero. SEÑALAR que Cajanal E.P.S., podrá repetir contra el FOSYGA lo que desembolse en cumplimiento del presente fallo. El FOSYGA dispondrá de quince (15) días para reconocer lo debido o indicar la fecha máxima dentro de la cual lo hará y luego, dará cumplimiento a la obligación reconocida.
Cuarto. Por Secretaría, líbrese la comunicación prevista en el artículo 36 del Decreto 2591 de 1991.
