PRIMERO. REVOCAR la sentencia de primera instancia proferida por el Juzgado
Cuarto. Penal del Circuito de Villavicencio el 6 de octubre de 2000 dentro del proceso identificado con el número de radicación 2000-046, promovido por la señora Martha Lucía Ramírez Espinosa
SEGUNDO. En su lugar, CONCEDER la tutela de los derechos a la salud y una vida digna de la señora Martha Liliana Ramírez Espinosa y en consecuencia ORDENAR al Instituto de Seguros Sociales que en el término de quince (15) días, contados a partir de la notificación de esta sentencia, programe la cirugía que requiere la señora Ramírez Espinosa, cuya solicitud realizó el Dr. Wilson German Quevedo.
TERCERO. INAPLICAR en este caso concreto, por implicar la violación de los derechos fundamentales señalados, la regla contenida en el parágrafo del artículo 28 del Decreto 806 de 1998 y las contenidas en la Resolución 5261 de 1994 que excluyeron del POS la aludida operación.
CUARTO. LÍBRESE por Secretaría la comunicación de que trata el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
