Primero. REVOCAR la sentencia proferida por el Juzgado
Segundo. Civil del Circuito de Ocaña, dentro de la acción de tutela instaurada por Hernán Ropero Vergel contra la Caja de Previsión Nacional -CAJANAL- E.P.S. - Seccional Norte de Santander-. En su lugar, CONCEDER el amparo solicitado.
Segundo. ORDENAR a la Caja Nacional de Previsión Social -CAJANAL- Seccional Norte de Santander, que dentro de las cuarenta y ocho (48) horas contadas a partir de la notificación de esta providencia, suministre al señor Hernán Ropero Vergel, el medicamento SECOTEX, en la forma prescrita por el médico tratante.
Tercero. Señalar que la Caja Nacional de Previsión Social -CAJANAL- Seccional Norte de Santander- le asiste el derecho de reclamar al FOSYGA los gastos asumidos en el suministro del medicamento SECOTEX.
Cuarto. Por Secretaría General, líbrense las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991, para los efectos allí contemplados.
