- PRIMERO. REVOCAR el fallo del 24 de febrero de 2000 del Juzgado Catorce Civil del Circuito de Bogotá, que negó la tutela solicitada por el actor Hernando A Gómez Prieto, y en su lugar, TUTELAR el derecho a la salud, en conexidad con la vida, del peticionario.
- SEGUNDO. ORDENAR a Colmena Salud que, dentro de las cuarenta y ocho horas siguientes a la notificación del presente fallo, autorice, de conformidad con las indicaciones médicas, el examen de carga viral del peticionario, así como los otros tratamientos que se requieran para proteger su vida digna. Esta EPS deberá asumir los costos del tratamiento y podrá repetir por los gastos adicionales en que incurra contra el Fondo de Solidaridad y Garantía, subcuenta de promoción de la salud.
- TERCERO. Por Secretaría líbrense las comunicaciones previstas en el artículo 36 del decreto 2591 de 1991.
