- Primero. REVOCAR la sentencia proferida el 31 de mayo de 2004 por el Juzgado Trece (13) Civil Municipal de Bogota, y en su lugar, CONCEDER la tutela de los derechos fundamentales a la salud en conexidad con el de la vida, y la seguridad social de la senora MARIA YOLANDA RETALLAK.
- Segundo. ORDENAR a la Secretaria de Salud de Bogota que, dentro del termino perentorio de cuarenta y ocho (48) horas contadas a partir de la notificacion de esta sentencia proporcione a su costa los medicamentos que la accionante requiere para el tratamiento de los males que padece, e igualmente ORDENAR a la Secretaria de Salud de Bogota para que en el termino de cuarenta y ocho (48) horas contadas a partir de la notificacion de este fallo, se inicien las diligencias pertinentes para la asignacion de una ARS a la accionante, de acuerdo a los cupos disponibles para ello, para que en adelante, se le presten los servicios de salud que esta requiera.
- Tercero. Por Secretaria, librese la comunicacion prevista en el articulo 36 del Decreto 2591 de 1991.
