Primero. Confirmar los fallos proferidos por el Juez
Séptimo. Civil del Circuito de Bogotá y por el Tribunal Superior del Distrito Judicial de Bogotá -Sala Civil de Decisión- en la acción de tutela interpuesta en el proceso de la referencia por Inés del Carmen Martínez Peña, en representación de su menor hijo, y, en consecuencia, Tutelar los derechos fundamentales y prevalentes a la salud y a la seguridad social del menor Rony Wilmer Peña Martínez.
Segundo. Ordenar a la Secretaría Distrital de Salud de Bogotá que dentro de las cuarenta y ocho (48) horas siguientes a la notificación del presente fallo y de no haber ocurrido este hecho, aplique la encuesta SISBEN al hijo de la accionante, se incluyan sus datos dentro de la base de datos de ese sistema, y se le informe si, de acuerdo con el resultado obtenido, tiene derecho a beneficiarse del régimen subsidiado de salud.
Tercero. Ordenar al Instituto de Seguro Social que dentro del término de tres (3) días contados a partir de la notificación de esta Sentencia, realice al menor Rony Wilmer Peña Martínez el tratamiento quirúrgico ordenado el 27 de julio de 2000 por el médico del Instituto de Ortopedia Infantil Roosevelt y ofrezca los cuidados posteriores mientras el SISBEN informa a la accionante, con carácter definitivo, si el menor ha sido admitido o no en el Sistema.
Cuarto. Dar cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
