- PRIMERO. REVOCAR, por las razones expuestas en esta Sentencia, el fallo del Juzgado 8º Penal del Circuito de Santafé de Bogotá D.C., que negó la tutela impetrada por Jorge Eduardo Valderrama y Martha Isabel Sánchez en contra de la EPS Seguro Social.
- SEGUNDO. ORDENAR a la EPS Seguro Social, Seccional Cundinamarca, que, dentro de las setenta y dos (72) horas subsiguientes a la notificación de este fallo, practique la intervención quirúrgica de cierre de colostomía requerida por el menor Dilan Eduardo Valderrama Sánchez, si es que aún no se ha practicado, y que continúe prestándole la atención debida en su calidad de beneficiario.
- TERCERO. DISPONER que si los servicios en salud prestados a Dilan Eduardo Valderrama Sánchez por la EPS Seguro Social no se encuentran dentro del plan obligatorio de salud (POS), ésta podrá repetir en contra del FOSYGA de conformidad con los procedimientos establecidos en la ley para el efecto.
- Cuarto. DESE cumplimiento a lo previsto por el artículo 36 del Decreto 2591 de 1991 y por consiguiente comuníquese esta sentencia al Juzgado 8º Penal del Circuito de Santafé de Bogotá D.C., que, a su vez, deberá verificar el cumplimiento del fallo.
