- Primero. REVOCAR la sentencia proferida por el Juzgado
- Segundo. Promiscuo de Familia de Facatativa el 24 de noviembre de 1999, por medio de la cual se nego la tutela impetrada.
- Segundo. INAPLICAR para el caso concreto el literal g) del articulo 15 del Decreto 1938 de 1994 en cuanto excluye el suministro de medicamentos que no se encuentren expresamente autorizados en el Manual de Medicamentos y Terapeutica a los ninos dentro del Plan Obligatorio de Salud.
- Tercero. CONCEDER la tutela impetrada por Elieser Parra contra la Secretaria de Salud de Cundinamarca, para proteger los derechos a la salud y a la seguridad social de su menor hija Gisseth Katherine Parra Moncada.
- Cuarto. ORDENASE a la Secretaria de Salud de Cundinamarca que en el termino de 48 horas suministre a la menor Gisseth Katherine Parra Moncada las hormonas de crecimiento ordenadas por su medico.
- Quinto. Por Secretaria librese la comunicacion prevista en el articulo 36 del decreto 2591 de 1991.
