- Primero. REVOCAR la sentencia proferida por el Juzgado Veintiséis (26) Civil del Circuito de Bogotá el 16 de abril de 2001, por las razones expuestas en la parte motiva de esta providencia. En consecuencia, CONCEDER la tutela impetrada por Amparo Pérez de Herrera contra la Secretaría Distrital de Salud de Bogotá, para proteger los derechos a la salud y a la seguridad social de su menor hijo Luis Enrique Herrera Pérez.
- Segundo. ORDENAR a la Secretaría Distrital de Salud de Bogotá que en el término de cuarenta y ocho horas (48) horas contados a partir de la notificación del presente fallo, realice las gestiones pertinentes para suministrar al menor Luis Enrique Herrera Pérez las hormonas de crecimiento ordenadas por su médico, ya sea directamente o a través de alguna entidad con la que tenga suscrito contrato para tal efecto.
- Tercero. SEÑALAR que a la Secretaría Distrital de Salud de Bogotá, le asiste el derecho de reclamar al FOSYGA los gastos asumidos en el suministro de las unidades de hormona de crecimiento prescritas, sólo en el evento de no disponer de recursos a los cuales pueda imputar legalmente dicha erogación.
- Cuarto. Por Secretaría líbrese la comunicación prevista en el artículo 36 del decreto 2591 de 1991.
