Se interpone la acción de tutela en representación de un menor de edad a quien le diagnosticaron trastornos endocrinos especificados, que se manifiestan en el niño por presentar talla baja.
Se alega que SURA E.P.S. violó derechos fundamentales del menor, al negarle el suministro de un medicamento específico ordenado por el médico tratante y hacer entrega de otro de carácter genérico.
Para dar solución al problema se reitera jurisprudencia constitucional relacionada con: 1º.
La protección del derecho constitucional fundamental a la salud mediante la acción de tutela. 2º.
La prevalencia y especial significación de los derechos de los niños y, 3º.
El suministro de la hormona de crecimiento como medicamento excluido del POS.
La Sala de Revisión decide confirmar la decisión de instancia que DENEGO el amparo solicitado.

- Primero. CONFIRMAR la sentencia proferida por el Juzgado Veintisiete Civil Municipal de Medellin en diciembre 13 de 2012, mediante la cual se denego la solicitud de tutela interpuesta por el senor Luis Fernando Ortega Martinez, en representacion de su hijo Thomas Ortega Gomez, menor de edad, contra Sura EPS.
- Segundo. Por Secretaria General, LIBRAR la comunicacion a que alude el articulo 36 del Decreto 2591 de 1991.
