- Primero. REVOCAR la sentencia proferida por el Juzgado
- Séptimo. Civil del Circuito de Barranquilla, de fecha 11 de agosto de 1998, la cual negó la acción impetrada y en su lugar CONCEDER la tutela de los derechos a la vida, salud e integridad física al señor JUAN DE DIOS RODRIGUEZ DE LA ROSA; en este sentido, ordenar que el I.S.S. Seccional Barranquilla, proceda dentro del improrrogable término de 48 horas contados a partir de la notificación de esta providencia, a suministrar al demandante los lentes para anteojos recetados conforme a la forma prescrita por el médico tratante de esa entidad.
- Segundo. INAPLICAR, para el caso concreto objeto de análisis por esta Sala, el literal f) del artículo 15 del Decreto 1938 de 1994, contenido a su vez en el acuerdo No. 008 de 1998, emanado del Consejo Nacional de Seguridad Social en Salud, en cuanto restringe el suministro de lentes para anteojos.
- Tercero. Líbrense las comunicaciones previstas en el artículo 36 del Decreto 2591 de 1991.
