- Primero. REVOCAR los fallos proferidos en el asunto de la referencia por el Juzgado 9 de Familia y por la Sala de Familia del Tribunal Superior de Santa Fe de Bogotá, mediante los cuales se negó la protección solicitada. En su lugar, SE CONCEDE la tutela del derecho al habeas data.
- En consecuencia, SE ORDENA a la Secretaría Distrital de Salud de Santa Fe de Bogotá que, dentro las cuarenta y ocho horas (48) horas siguientes a la notificación del presente fallo, se efectúe encuesta SISBEN al hijo de la peticionaria, se incluyan sus datos dentro del banco de datos de ese sistema, y se le informe si, de acuerdo con el resultado obtenido, tiene derecho a beneficiarse del régimen subsidiado de salud
- Segundo. DESE cumplimiento a lo previsto en el artículo 36 del Decreto 2591 de 1991.
