Demanda de Inconstitucionalidad contra el parágrafo transitorio del artículo 103 de la Ley 1438 de 2011, Por medio de la cual se reforma el Sistema General de Seguridad Social en Salud y se dictan otras disposiciones.

El demandante centra la acusación en el parágrafo del artículo 103, el cual establece la vigencia de la prohibición de vincular personal misional permanente de las instituciones públicas prestadoras de salud, mediante cooperativas de trabajo asociado que hagan intermediación laboral.

La Corte no encuentra fundamento alguno para realizar pronunciamiento de fondo, ya que lo acusado fue derogado tácitamente por el artículo 276 de la Ley 1450 de 2011 y está produciendo efectos jurídicos.

Decide INHIBIRSE de emitir pronunciamiento alguno.
