- PRIMERO. REVOCAR la sentencia proferida por el Juzgado
- Primero. de Ejecución de Penas y Medidas de Seguridad de Medellín, del 28 de enero de 2000, y en su defecto TUTELAR el derecho a la vida del accionante, por las razones expuestas en la parte motiva de esta sentencia.
- SEGUNDO. ORDENAR a la EPS Comfenalco, que se le suministre los audífonos al actor y que otorgue la asistencia necesaria para su adaptación, de conformidad con las necesidades del accionante. Así mismo, la EPS Comfenalco, podrá acudir al Fondo de Solidaridad y Garantía FOSYGA, para solicitar el reembolso de los dineros causados en virtud de lo anteriormente ordenado.
- TERCERO. Para los efectos del artículo 36 del decreto 2591 de 1991, el juez de origen hará las notificaciones y tomará las medidas conducentes para el cumplimiento de esta sentencia.
