  1. Primero. CONFIRMAR el fallo proferido por la Sala Civil del Tribunal Superior de Medellin, del 5 de noviembre de 1998, adicionandolo en el sentido de que se debera realizar por parte del ISS, la cirugia requerida por el menor Jhonathan Ruiz Alarcon.
  2. Segundo. ORDENAR al ISS, para que en el evento en que aun, si la cirugia mencionada no se ha realizado, proceda en el plazo maximo de cuarenta y ocho (48) horas contadas a partir de la notificacion del presente fallo, a realizar de manera efectiva la intervencion quirurgica requerida por el menor Jhonathan Ruiz Alarcon, de lo cual debera informar a la Sala Civil del Tribunal Superior de Medellin, juez de instancia de la presente tutela, dentro de las siguientes cuarenta y ocho (48) horas a su realizacion.
  3. Tercero. Se advierte al ISS, que de verificarse el incumplimiento de lo ordenado en este fallo, se hara acreedor a las sanciones senaladas en los articulos 52 y 53 del decreto 2591 de 1991.
  4. Cuarto. Por Secretaria General, librense las comunicaciones de que trata el articulo 36 del decreto 2591 de 1991.
